Mediation

Mediation is a voluntary, private, facilitative process of dispute resolution in which a skilled and neutral mediator assists parties, with advice from their lawyers, to resolve outstanding issues.

While mediation may be used to settle cases outside the court process, it may be used in tandem with or as an “off ramp” from litigation.

Mediation is less adversarial and less costly than litigation and provides an opportunity for parties to reach creative and long-lasting settlements of their legal rights and obligations (often including terms that are unavailable in litigation).

As mediator, Michael Kleinman strives to improve communication between opposing parties and their counsel and, in turn, negotiate settlements which satisfy the interests of both parties and minimize the possibility of future disputes.

Arbitration

Arbitration is a formal, binding dispute resolution process that yields private, efficient and enforceable decisions in related to disputed issues.

As arbitrator, Michael Kleinman works closely with counsel to achieve significant advantages over the litigation process including customized procedural rules, an expedited timetable, subject-matter expertise and confidentiality.
